Ireland, United States Marshal for Utah Territory, party of the first part, and Catharine Davis, of Salt Lake City, party of the second part Witnesseth whereas by virtue of a certain unit of Execution issued out of, & under the seal of the Dis- -trict Court of the 3d Judicial District of said Territory, tested the 25th day of May 1883, on a Judgment rendered by said Court on the 18th day of September 1880, in favor of Catharine Davis, and against Samuel L. Jones, to the said Marshal di[-]ted and delivered, commanding him that out of the personal prop- -erty of the said Judgment debtor he should come to be made certain m[---]s specified in said writ, or if sufficient personal property could not be found, then he should cause the amount of said Judgment to be made out of the [---] property belonging to said Judgment debtor on said 18th day of September 1880, or any time thereafter. And whereas, [---] sufficient personal property of the said Judgment debtor could not be found, whereof the said Marshal could come to be made the monies specified in the said writ, he, the said Marshal, did, in obedience to the said command, buy on, take & seize all the estate, right, title & interest held on said 18th day of September, 1880, or thereafter acquired by said Judgment debtor, of in & to the [---] property [---] after ----- new page (44913.jpg) particularly set faith & d[---]ed, with the app[-]t[---]s, & did on the 20th day of June, 1883. sell the said right, title & intent of the said judgment debtor in & to said property, by public auction, at the front door of the County Court House in the City & county of Salt Lake, in said Teritory, at the hour of 12 o'clock M. on said day, he having first given due notice of the time & place of said sale according to law; at which sale all said right, title & intent of said Judg- -ment debtor in or to said property was struck off & sold to the said party of the second part hereto, for the sum of $139 80/100, she being the highest bidder, & that being the highest sum bid for the same.— Whereupon said Marshal, executed & delivered to said party of the second part such artifacts of said sale as is by law directed to be given, & caused a duplicate thereof to be filed in the office of the County Recorder of the county of Salt Lake. And whereas, more than six months have elapsed since the day of said sale, & no redemption of the property so s[--]d has been made. Now this Indenture Witnesseth, that the said party of the first part, Marshal as aforesaid, by writer of said Execution, & in pursuance of the Law in consideration of the promises, & of the money so as aforesaid bid & paid by said party of the second ----- new page (44914.jpg) second part, the recipt whereof is hereby acknowl- -edged, has granted, bargained, sold, conveyed and confirmed, & by these presents does grant, bargain, sell, convey & confirm, with the said party of the second part, her heirs & assigns favour, all the estate, right, title & interest held by said judgment debtor on said 18th day of September 1880, or thereafter acquired, of in & to the following described p[---] or panal of land, to wit: Lot Elev[--] (11) Block five (5) Plat "E."
